The socio-legal JustISA project examines international surrogacy arrangements (ISAs) through the normative capability approach, addressing justice-related issues such as the child’s best interests, the desire for parenthood, legislative circumvention, and the impact of questionable practices on individuals (children, surrogates, intended parents) and legal systems. Research data include online sources and agreements from Colombia and Greece. ISAs are analyzed in relation to Finland’s surrogacy ban and principles of parenthood formation. A key question is whether the circumstances of a child’s birth should influence recognition of parent–child relationships in Finland—and whether prohibiting national arrangements is legally sustainable if international ones must be recognized in the name of the child’s best interests.
